Terms and Conditions
Legal
These Terms and Conditions are subject to the Laws of the United Kingdom, therefore, so too are the legal rights of those involved, namely you - the Customer, and us at SCMWebdesign - the service provider. We reserve the right to alter these Terms and Conditions at any time and without notice should it be judged necessary by us to protect our business.
Design
SCMWebdesign will design and build Flash Banners, Navigation bars and Websites to the highest standards we can, and where the greatest care will be taken to ensure full functionality on all products that we create, we cannot be held responsible for any loss of operation that may occur due to reasons outside of our control.
SCMWebdesign's work is guaranteed, but should any of our Banners, Navigation bars or Websites that you purchase be altered by any hostile agencies that disrupt or alter the original product, its design or coding, we cannot be held responsible for its repair or replacement. However, depending on each circumstance, we reserve the right to judge accordingly the situation and therefore our response.
Please take a few minutes to read these Terms and Conditions, as you will be bound by them once you have agreed a Contract with us or purchased goods. If there is anything that you do not understand, please contact us for further clarification.
The Customer takes full responsibility for any content that you supply to us for the purpose of adding to your website. Any copyright infringements for images, text or other material supplied by you are to be dealt with by you, the Customer. SCMWebdesign accepts no responsibility to where any content may originate.
SCMWebdesign reserve the right to reject any content supplied by you for your website if we deem the material to be of an unacceptable nature.
Where a date is set for the completion of the Website, the Customer accepts responsibility to supply the required material in time for us to build the website to meet that agreed deadline.
Copyright
SCMWebdesign retain all copyrights to any Banners or Navigation bars that we design and build. The Customer is purchasing a license to use the products, and cannot at any time resell them in part or whole, or make them available to a third party. You can use them on any website that you personally own, but cannot use them for websites that you run or maintain for a third party.
SCMWebdesign will do all that it can to meet any agreements made between us and the Customer, but should events occur outside of our control that delay or prevent the completion of the work, SCMWebdesign reserve the right to judge accordingly our response. If the Customer proves to be negligable in any matters that may delay or prevent the work being completed, SCMWebdesign cannot be held liable to any loss the Customer may incur.
SCMWebdesign are a Web Design Company that constructs Flash Content and mainstream Websites for Customers. SCMWebdesign are not a Hosting or Domain Name Registration Company, and even though we will use external Companies to register your Domain Name and Host your Website, should the services of such Companies fail, we cannot be held liable for any lost down time that your Website may incur. Upon completion of your Website, we will send you details of who your Registration and Hosting Companies are, and it will be your responsibility to contact them directly should any problems occur. Initially, we will offer support that will help you deal with any unforeseen situations, but should you suffer ongoing problems, our advice will be suggestive and cannot guarantee that it will resolve the issue. Therefore, we cannot be held accountable should further losses be incurred by you the Customer.
Payment
A non-returnable deposit of 20% is to be paid by the Customer to SCMWebdesign prior to any work commencing. Upon completion of the Website, the Customer is to pay a further 40% before the finished Website goes live. A third installment of 40% is then to be paid within 30 days. A 5% discount is available if the Customer pays immediately after the Website has gone live. These payment terms are non-negotiable.
If you, the Customer, decide you no longer want the Website, especially if the Website is near to completion, SCMWebdesign will charge you a 50% cancellation fee in addition to the 20% deposit. However, if you cancel shortly after us beginning your Website, you will be charged a flat rate of £15.00 per hour for work already done, and this will be in addition to the deposit charge. Failure to pay will result in legal action, so please make sure you are happy with the initial agreement and basic design before signing the contract.
Ongoing Support will continue after full payment has been made, especially during the first few months of your Website's operation. SCMWebdesign understands that this will be an important time for your business or organisation, and minor changes can still be made. We do however reserve the right to decide just how much support is to be given and how many changes can be made. For added security, you may wish to purchase a couple of hours support, be it on a weekly/monthly/annual basis. This can be arranged for a fee of £15.00 per hour.
SCMWebdesign will test our products in the most popular browsers like Internet Explorer and Mozilla's Firefox, however, due to there being so many browsers available, we cannot guarantee that all browsers will produce the correct functionality for our products.
Search Engine Optimisation
Due to everchanging methods used by Search Engines like Google and Yahoo, we cannot guarantee ongoing high rankings for your Website. We will do our utmost under present conditions to optimise your website, but ultimately other major factors come into play that are simply out of our control. For example, how many other websites add links from their website to yours will be down to your actual content and whether they deem your site worthy of such links. This factor alone can make a huge difference to your rankings, and subsequently will decide where your website ends up on Search Engine searches.
Privacy
We will not share your details with any third party, although we reserve the right to add links from our website to yours for our own advertising purposes. This can only benefit you in the long term.
Websites
SCMWebdesign are not responsible for any issues that may arise between you, the Customer, and anyone you deal with through your Website. Once the Website is complete and full payment has been made by you, the Customer to SCMWebdesign, we will no longer be held accountable for your Website as a whole, other than a basic Support Service that you may require should unforeseen problems with the Website itself arise.

SCMWebdesign will work with the Customer to build a Website that is functional and to the Customer's original design and requirements. The Contract agreed by both parties prior to work commencing is binding and should be read in conjunction with these terms and conditions.
For Websites that SCMWebdesign build, we will retain the copyright to the Website until full payment has been made. However, we do not lay claim to any content that you may supply, like images or text, the copyright to these will remain yours or those from where you obtained them.
If you, the Customer, decide to alter anything that we have created, you accept full responsibility for such actions, and cannot expect us to replace or repair any faults that may result.
